A white California man who walked onto a middle school campus and randomly attacked a 12-year-old black student is getting off without even a citation.

This week, the East Bay Express reported that local law enforcement officials in Berkeley, California will not prosecute an unnamed white man who drove up to the Willard Middle School campus and attacked a young black boy in March.

Witnesses on the scene said the boy, who was 12, was horseplaying with a fellow student (a white female) when a man driving a pickup truck saw the boy pick up and drop the girl and promptly u-turned and exited his vehicle to chase the boy on foot. The boy, in an attempt to get away from the adult chasing him, ran into the street. At that point, a sedan driving by ran over the boy’s foot, and the white man chasing him tackled the boy to the ground.

Glenda Secrease, the boy’s grandmother and legal guardian, said that after the white man tackled him, he threatened the student, reportedly saying, “Oh, you want to fight girls? Oh, you want to die motherfucker? Because I can kill you motherfucker.”

Officer Byron White, who responded to the scene of the attack, wrote that while the truck driver “may have made better decisions,” he believed no citation was necessary in his estimation, saying the attacker didn’t mean any harm to the student.

Willard Middle School safety officer Pamela Stewart told the Express that had the races of the attacker and victim been different, it’s unlikely prosecutors wouldn’t have filed charges.

“We all know if it had been reversed and if this had been a black man who ran down a white kid, we would be in a whole other situation right now,” Stewart said. “It was traumatizing for [students] because nobody knew who this guy was and we still don’t know who he is. There have been no consequences for what he did.”

Berkeley police still have not found the driver of the sedan who ran over the student’s foot in the street. The name of the man who attacked the student has not been made public as of this writing.
